The relationship between the parties is governed by the following normative acts:

OG no. 21/1992 on consumer protection with subsequent amendments and additions.

GEO no. 34/2014 on consumer rights in contracts concluded with professionals, as amended and supplemented.

Law no. 363/2007 on combating unfair practices of traders in relation to consumers and harmonization of regulations with European consumer protection legislation, with subsequent amendments and additions.

Law 365/2002 on e-commerce, with subsequent amendments and additions.

DEFINITIONS:

Seller - SC REMENYI KRIS ART SRL(which owns the registered trademark HER)

Contract of sale - any contract under which the seller transfers or undertakes to transfer the ownership of goods to the customer (consumer, buyer) and the customer pays or undertakes to pay the price of the goods.

Consumer (customer, purchaser) - any natural person or group of natural persons constituted in associations, which, in accordance with the contractual terms and conditions, acts for purposes outside its commercial, industrial or production, craft or liberal activity.

Shopping cart - section of the Account that allows the Buyer/Customer to add products they wish to purchase at the time of adding or at a later time.

Website - online shop hosted at www.her-shop.ro

Order - an electronic document that intervenes as a form of communication between the Seller and the Buyer by which the Buyer transmits to the Seller, through the Site, his intention to purchase products from the Site.

Products - any goods to be supplied by the Seller to the Buyer as a result of the Contract entered into.

PRODUCT AVAILABILITY:

Products listed on www.her-shop.ro may have one of the following availabilities:

• "in stock" - we have more than 5 pieces in the seller's stock;
• "out of stock" - the good is no longer available in the seller's stock.

In the event that a product is not available in stock (out of stock / currently out of stock) after the customer has placed the order, the seller will take all the necessary steps to deliver the order to the customer.

ORDERING PRODUCTS:

In order to order products from the website www.her-shop.ro the interested person must access the above website.

In view of placing the order, the customer will select the products he wants to purchase by adding them to the shopping cart.

In order to finalize the order the customer must fill out the form for this step, then select the "place order" button.

After this procedure, the customer will receive a message from the seller informing him that his order has been taken into consideration.

The order taking consists of internal operations carried out in order to communicate and optimize the performance of the responsible departments.

Orders are taken according to the date they were placed.

!Important: by taking the order does not mean delivery of the order.

After the order is taken, it is transmitted (communicated) to the responsible department in order to identify, select, package the products that are the subject of the order.

Products that will no longer be in stock at the time of assembling the package will be automatically removed from the order, with prior notice to the buyer.

After the products have been identified, selected and packed, they are sent for delivery to the courier according to the order placed.

The procedure of identification, selection and packaging of the products (in order to be forwarded to the courier parcel) that are the object of the order is carried out in 1-2 working days, from the order.

HER has made every effort to display product colors as realistically as possible. However, the color of the items displayed on the screen may change depending on the quality of the device on which the product is viewed. Therefore, HER cannot guarantee that the colors that appear on the monitor are a true representation of the actual colors.

DELIVERY OF PRODUCTS

The delivery of products in Romania is realized within 1-3 working days from the identification, selection and packaging of products.

Delivery of products in the EU is realized within 7-14 working days from the identification, selection and packaging of the products.

Orders are not cumulative, each order placed is a stand-alone order. You cannot place more than one order, and then cumulate them.

For example, if a customer places 2 orders, both with courier fee, then the orders will be collected separately and he will pay the courier fee for each. Each parcel will contain the products that the customer added to the order.

The delivery deadlines provided in this section may be subject to change due to the intervention of objective factors beyond the seller's control, so there may be delays for various reasons such as (but not limited to): holidays, unfavorable weather conditions, discount periods, busy periods, technical problems beyond the seller's control, etc. 

TELEPHONE ORDERS

Placing telephone orders is at your own risk. SC REMENYI KRIS ART SRL REMENYI KRIS ART SRL is not responsible for any errors / misunderstandings regarding the address, phone number, products, color shades, etc..

CANCEL ORDERS:

There are situations in which an order cannot be delivered to the customer, for various reasons (product unavailable, kits not available, use of certain discount codes without the consent of the Trainer for which it was created, incomplete/incorrect delivery data, etc.) In this case, the customer is contacted by phone by a Call Center representative. If the customer does not answer the phone, then he/she will be notified in writing, via e-mail, with the situation in question and the request for a response. If the customer does not contact us within 48 hours (working days), by a reply to the e-mail or by phone at +40 751 894 492 (Monday-Friday, between 9:00-17:00), the order is automatically canceled in the system.

The customer can also benefit from the right to cancel the order, if he informs the seller of his intention before the conclusion of the contract.

PRICE :

Product prices are expressed in RON, and VAT is included in the displayed price.

All products will be delivered subject to stock availability. Vouchers or other forms of loyalty are not transferable and can not be accumulated.

The transportation fee is calculated on the amount actually paid, after applying the discount coupon.

The prices are valid as from their publication, except in cases of material errors, in particular but not limited to prices that have been posted with obvious mistakes, significantly different from the market value or those posted due to a system error.

In this case, the seller is not obliged to deliver the product at the incorrect price. The seller will inform the customer about this and offer to deliver the product(s) at the actual price.

Preliminary information:

The prices are mentioned to the right of each product and are expressed in LEI (RON - monetary unit of Romania) and VAT is included in the displayed price. The final price paid by the customer consists of the purchase price of the product, plus the cost of transportation. her-shop.ro does not charge any other additional tax. All products will be delivered within stock availability.

PRODUCT WARRANTY:

All products sold by www.her-shop.ro benefit from warranty conditions in accordance with current legislation. The products are new, in original packaging and benefit from the legal guarantee of conformity, in accordance with the provisions of Law no. 296/2004 on the Consumer Code, as amended and supplemented by the provisions of Emergency Ordinance no. 140 - 28/12/2021 on the sale of products and associated guarantees, as amended and supplemented.

The electronic/electrical products purchased through www.her-shop.ro benefit from the commercial warranty, granted by the manufacturer for a determined period, according to each product. Thus, each electronic/electrical product delivered will be accompanied by the warranty certificate or declaration of conformity with the specifications of the manufacturer or importer.

If the electronic products are defective and they benefit from the warranty period provided above, the customer can send the defective product to the address provided in this section/contact- for repair.

In this case, the transportation cost is paid as follows: the customer bears the transportation costs when sending the product for service, and the seller will bear the transportation costs when sending the product to the customer.

RETURNING PRODUCTS

In accordance with the provisions of the EMERGENCY ORDINANCE no. 34 of June 4, 2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing certain normative acts, with subsequent amendments and competences, the customer (consumer) benefits from the right of withdrawal from a distance contract (return of products).

The customer has a period of 14 calendar days to withdraw from a distance or off-premises contract, without having to justify the withdrawal decision and without incurring any costs other than those related to the return of the product.
